Welcome to Party VPN. These Terms of Service ("Terms") govern your use of our VPN services and website. By creating an account or using our services, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our services.
Party VPN is operated by Party VPN, a Delaware corporation with operations in the United States.
1. Acceptance of Terms
By accessing or using Party VPN's services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Party VPN.
If you are using our services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
2. Eligibility
You must be at least 18 years of age to use Party VPN's services. By using our services, you represent and warrant that:
- You are at least 18 years old
- You have the legal capacity to enter into a binding agreement
- You are not prohibited from using our services under applicable laws
- All information you provide to us is accurate and current
We reserve the right to refuse service to anyone for any reason at any time.
3. Account Registration
Creating an Account
To use Party VPN, you must create an account by providing:
- A valid email address
- Your first and last name
- A secure password
Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use of your account
- Ensuring your account information remains accurate and up-to-date
Party VPN will not be liable for any loss or damage arising from your failure to maintain account security.
Account Restrictions
You may not:
- Share your account credentials with others
- Create multiple accounts for yourself
- Use another person's account without permission
- Sell, transfer, or sublicense your account to others
4. Service Description
Party VPN provides usage-based VPN services using the WireGuard protocol. Our service allows you to:
- Create VPN connections to servers in multiple locations worldwide
- Encrypt your internet traffic for enhanced privacy and security
- Access the internet through our VPN infrastructure
Usage-Based Billing Model
Unlike traditional subscription VPN services, Party VPN bills based on actual usage:
- You are charged an hourly rate when your VPN connection is active
- A VPN is considered active if a WireGuard handshake occurred within the last 60 minutes
- Billing checks occur hourly; if your VPN is active during a check, you are charged for that hour
- You are not charged when your VPN is idle (no handshake in the last 60 minutes)

Service Modifications
We reserve the right to modify, suspend, or discontinue any aspect of our services at any time, with or without notice. This includes, but is not limited to:
- Adding or removing server locations
- Changing pricing structures
- Updating VPN protocols or software
- Implementing new features or removing existing ones
5. Payment and Billing
Cryptocurrency Payments
Party VPN accepts cryptocurrency payments only. We support multiple cryptocurrencies including, but not limited to:
- Bitcoin (BTC)
- Ethereum (ETH)
- Solana (SOL)
- USDT (Tether)
- USDC (USD Coin)
- XRP (Ripple)
- BNB (Binance Coin)
- Litecoin (LTC)
All cryptocurrency payments are processed through our payment provider, OxaPay.
Account Credits
When you make a cryptocurrency payment:
- Your account is credited with the USD equivalent value of the cryptocurrency received
- Credits are deducted hourly based on your VPN usage
- You can view your current credit balance and transaction history in your dashboard
- You may add credits to your account at any time in increments as low as $1 USD
Billing Cycle
Usage billing occurs automatically:
- Your VPN status (active or idle) is checked every hour
- If active, the applicable hourly rate is deducted from your account credits
- When your account balance reaches zero, your VPN connections will be suspended until you add more credits
Payment Responsibility
You are responsible for:
- Ensuring sufficient credits in your account to maintain service
- Any blockchain transaction fees associated with cryptocurrency payments
- Monitoring your account balance and usage
- Understanding that cryptocurrency transactions are irreversible
6. Refund Policy
Due to the nature of cryptocurrency payments and our usage-based billing model, we do not offer refunds for the following reasons:
- Cryptocurrency transactions are irreversible and cannot be charged back
- You can add credits in amounts as low as $1 USD, allowing you to test our service with minimal financial commitment
- You are only charged for actual VPN usage, not for idle time
- Managing cryptocurrency refunds is operationally impractical given the decentralized nature of blockchain payments
Unused Credits
Unused credits remain in your account and can be used at any time. Credits do not expire unless your account is terminated for violations of our Acceptable Use Policy.
Account Termination
If we terminate your account for violations of these Terms or our Acceptable Use Policy:
- You forfeit all unused credits
- You are not entitled to any refund or compensation
- Outstanding balances do not transfer to any new account
7. Acceptable Use Policy
While Party VPN is committed to user privacy, we have a zero-tolerance policy for abuse of our services. You agree not to use Party VPN for any unlawful or prohibited activities.
Prohibited Activities
You may not use Party VPN to commit, facilitate, or attempt any unlawful activity. This includes any activity involving financial fraud (credit card fraud, money laundering, carding), cybercrime (malware, botnets, phishing, credential trafficking, ransomware), distribution or possession of child sexual abuse material (CSAM), terrorism or terrorist financing, human trafficking, sale or distribution of illegal drugs or weapons, forging or trafficking of identity documents, facilitation of darknet marketplaces, evading international sanctions or export controls, publishing instructions to commit violent or criminal acts, and any other conduct that would constitute a criminal offense under applicable law.
Party VPN will treat suspected violations seriously and may suspend or terminate accounts, block traffic, preserve and disclose information to law enforcement, and take any other necessary action.
The following activities are strictly prohibited:
- Financial & fraud crimes
- Credit card fraud, fraudulently obtaining or using payment credentials, carding, or running or facilitating "carding" shops
- Wire fraud, check fraud, tax fraud, investment fraud, or other schemes to defraud individuals or businesses
- Money mule operations and facilitating or offering services to launder money (including mixing/tumbling services)
- Fraudulent or deceptive business practices (scams, advance-fee fraud, Ponzi schemes)
- Cybercrime & abuse
- Operating, distributing, or providing access to malware, ransomware, botnets, command-and-control infrastructure, or ransomware-as-a-service
- Developing, selling, or distributing tools designed primarily to facilitate hacking, credential stuffing, brute-force attacks, or the circumvention of security (e.g., credential-cracking tools, exploit kits)
- SIM-swap facilitation, trafficking in stolen credentials, or facilitating account takeover
- Hosting or coordinating phishing sites, skimming pages, or other credential-harvesting infrastructure
- Unauthorized access to, exfiltration of, sale or distribution of stolen data, including personally identifiable information (PII), financial records, or login credentials
- Launching DDoS attacks or other denial-of-service attacks
- Conducting unauthorized network scanning, including mass port scanning or vulnerability scanning without permission
- Sending spam or unsolicited bulk communications
- Illicit trade & marketplaces
- Buying, selling, or facilitating transactions of illegal goods or services (weapons, explosives, stolen goods, counterfeit goods, illicit wildlife products)
- Operating or promoting darknet market activity, trafficking in illegal drugs, or facilitating illegal drug sales (online or in person)
- Selling or distributing illegal or restricted pharmaceuticals, controlled substances, stimulants, or drug paraphernalia
- Identity & document crimes
- Forgery, producing or selling forged documents (fake IDs, passports, certificates), or facilitating identity fraud
- Creating or selling fake or fraudulent credentials for illicit purposes
- Violence, exploitation & sexual crimes
- Distribution, facilitation, or possession of child sexual abuse material (CSAM) — zero tolerance
- Production, distribution, or solicitation of sexual exploitation or revenge porn
- Organizing or facilitating violent criminal acts, threats of harm, or coordinating criminal gangs/terrorist cells
- Terrorism & extremism
- Providing material support to terrorist organizations, creation or distribution of terror propaganda, recruitment, or financing of extremist organizations
- Facilitating or coordinating terrorist financing, training, or operational planning
- Weapons & hazardous materials
- Marketing, selling, or facilitating the procurement of firearms, ammunition, explosives, or chemical/biological agents in violation of law
- Providing instructions to build weapons or explosives
- Regulatory, export, and sanctions violations
- Evading international trade controls or export controls, facilitating sanctioned-party transactions, or helping users evade economic sanctions
- Assisting or instructing others to evade regulatory or compliance obligations (e.g., export controls, customs fraud)
- Intellectual property & circumvention
- Distributing copyrighted material without authorization, operating piracy sites, or running infrastructure intended to facilitate mass distribution of pirated content (including unauthorized streaming). Party VPN is subject to the US Digital Millennium Copyright Act (DMCA)
- Selling or distributing circumvention devices or software that defeats DRM or access controls
- Harassment, doxxing & threats
- Doxxing (publishing private information with intent to harm), stalking, harassment, serious threats to persons or property, or organizing harassment campaigns
- Revenge porn, non-consensual intimate imagery, or threats intended to coerce or intimidate
- Illicit instructions & facilitation
- Publishing or distributing instructions that meaningfully facilitate wrongdoing (e.g., how to build bombs, evade law enforcement, commit large-scale fraud)
- Providing or advertising services that facilitate others committing crimes (e.g., hit-for-hire services, hit-lists)
- Illegal gambling & gaming
- Operating or facilitating illegal gambling operations where such activity is banned or requires local licensing
- Service-specific prohibitions
- Reselling or sublicensing our VPN service to third parties
- Abusing bandwidth or resources in a manner that degrades service for other users
- Circumventing security measures or attempting to breach our systems
Enforcement
Violations of this Acceptable Use Policy will result in:
- Immediate suspension or termination of your account without prior notice
- Forfeiture of all unused account credits without refund
- Potential reporting to law enforcement authorities
- Legal action to recover damages or enforce our rights
Reporting Abuse
If you become aware of any violations of this Acceptable Use Policy, please report them immediately through our Help Desk or by contacting us here.
8. Service Availability and Uptime
Service Targets
We strive to provide reliable VPN services with a target uptime of 99.9%. However, this is a target, not a guarantee.
No Service Level Agreement (SLA)
Party VPN does not offer a Service Level Agreement. Given our affordable usage-based pricing model, we provide VPN services at rates as low as $0.03 per hour. While we are committed to delivering high-quality service and maintaining excellent uptime, we cannot guarantee uninterrupted availability.
Service Interruptions
Our services may be interrupted due to:
- Scheduled maintenance
- Server upgrades or migrations
- Network outages or infrastructure failures
- DDoS attacks or security incidents
- Acts of God or events beyond our reasonable control
We will make reasonable efforts to notify you of scheduled maintenance in advance, but we are not obligated to do so.
No Compensation for Downtime
You will not be charged for hours when your VPN is idle or unavailable. However, we do not provide credits, refunds, or other compensation for service interruptions or downtime.
9. Intellectual Property
Our Intellectual Property
All content, features, and functionality of Party VPN, including but not limited to:
- Software, code, and APIs
- Website design, layout, and graphics
- Logos, trademarks, and branding
- Documentation and user guides
are owned by Party VPN and are protected by United States and international copyright, trademark, patent, and other intellectual property laws.
License to Use
We grant you a limited, non-exclusive, non-transferable, revocable license to:
- Access and use our VPN services for personal, non-commercial purposes
- Download and use our client software on your devices
This license does not permit you to:
- Modify, copy, distribute, or create derivative works from our software or services
- Reverse engineer, decompile, or disassemble our software
- Use our services for commercial purposes without written permission
- Remove or alter any copyright, trademark, or proprietary notices
Third-Party Software
Our services may incorporate open-source software, including the WireGuard protocol. Such software is governed by its respective licenses, which we will honor and comply with.
10. Privacy and Data Protection
Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.
Key privacy commitments:
- We do not log your VPN traffic or browsing activity
- We do not sell your personal information to third parties
- We collect only the minimum data necessary to operate our services
- We use industry-standard encryption to protect your data
By using our services, you consent to our data practices as described in our Privacy Policy.
11. Disclaimers and Warranties
"AS IS" Service
PARTY VPN SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
To the fullest extent permitted by law, Party VPN disclaims all warranties, including but not limited to:
- Warranties of merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy, reliability, or completeness of services
- Uninterrupted, secure, or error-free operation
No Guarantee of Security
While we use industry-standard encryption and security measures:
- We cannot guarantee absolute security or privacy
- No internet transmission is completely secure
- You use our services at your own risk
No Legal or Professional Advice
Party VPN does not provide legal advice. You are responsible for ensuring your use of our services complies with all applicable laws in your jurisdiction.
Third-Party Services
We are not responsible for the actions, content, or services of third parties, including:
- Websites or services you access through our VPN
- Third-party payment processors
- Hosting providers or infrastructure partners
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PARTY VPN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, WHETHER IN AN ACTION IN CONTRACT, TORT, OR OTHERWISE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OUR SERVICES.
IN NO EVENT SHALL PARTY VPN'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID TO PARTY VPN IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
Exclusions
This limitation of liability applies to:
- Service interruptions or downtime
- Data loss or corruption
- Unauthorized access to your account
- Errors, bugs, or security vulnerabilities
- Actions of third parties
- Your reliance on our services
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages. In such jurisdictions, our liability is limited to the greatest extent permitted by law.
13. Indemnification
You agree to indemnify, defend, and hold harmless Party VPN, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including attorney's fees) arising from:
- Your use or misuse of our services
- Your violation of these Terms or our Acceptable Use Policy
- Your violation of any law or regulation
- Your violation of any third-party rights, including intellectual property rights
- Any content you transmit through our services
We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you will cooperate with us in asserting any available defenses.
14. Account Termination
Termination by You
You may terminate your account at any time by:
- Opening a support ticket through the Help Desk in your dashboard
- Contacting our support team
Upon voluntary termination:
- Your account and personal data will be deleted
- You will lose access to all VPN services
- Any unused account credits will be forfeited (no refunds)
- Payment transaction records may be retained for legal and accounting purposes
Termination by Party VPN
We reserve the right to suspend or terminate your account immediately, without prior notice, if:
- You violate these Terms or our Acceptable Use Policy
- You engage in fraudulent or illegal activities
- You abuse our services or degrade service quality for others
- We are required to do so by law or court order
- We decide to discontinue our services
Effect of Termination for Violations
If we terminate your account for violations:
- You immediately lose access to all services
- All unused account credits are forfeited without refund
- You are prohibited from creating new accounts
- We may report violations to law enforcement authorities
- You remain liable for any damages caused by your violations
Survival
Provisions of these Terms that by their nature should survive termination will survive, including but not limited to: payment obligations, indemnification, limitations of liability, and dispute resolution.
15. Dispute Resolution and Arbitration
Binding Arbitration
YOU AND PARTY VPN AGREE THAT ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF OUR SERVICES SHALL BE RESOLVED EXCLUSIVELY THROUGH BINDING ARBITRATION, RATHER THAN IN COURT.
Arbitration Procedures
Arbitration shall be conducted in accordance with the following:
- Governing Rules: The American Arbitration Association (AAA) Commercial Arbitration Rules
- Location: Arbitration shall take place in Delaware, USA
- Language: English
- Number of Arbitrators: One neutral arbitrator
Exceptions to Arbitration
Either party may seek injunctive or equitable relief in court to:
- Prevent intellectual property infringement
- Enforce confidentiality obligations
- Prevent irreparable harm
Class Action Waiver
YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. All disputes must be brought on an individual basis.
Informal Resolution
Before initiating arbitration, you agree to attempt to resolve the dispute informally by contacting our support team. We will attempt to resolve the dispute within 30 days.
16. Governing Law and Jurisdiction
These Terms and your use of Party VPN shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of law provisions.
Any disputes not subject to arbitration (as described above) shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of such courts.
17. Changes to These Terms
We may update these Terms of Service from time to time to reflect changes in our services, legal requirements, or business practices. When we make changes:
- We will update the "Last Updated" date at the top of this page
- For material changes, we may notify you via email or display a prominent notice on our website
- Continued use of our services after changes become effective constitutes your acceptance of the updated Terms
We encourage you to review these Terms periodically to stay informed about your rights and obligations.
Notification of Changes
You are responsible for regularly reviewing these Terms. If you do not agree to the modified Terms, you must discontinue using our services.
18. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
19. Entire Agreement
These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Party VPN regarding your use of our services and supersede all prior agreements and understandings.
No Waiver
Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
